How to tell us about infringing material, and what happens next.

01Where we stand

In plain English

Upload only music you have the rights to. We act on valid takedown notices.

The Mix Medic processes audio that users upload. Uploading music you do not hold the rights to breaks our Terms of Service. We respond to valid notices under the Digital Millennium Copyright Act and will disable access to infringing material.

Uploaded audio is private to the account that uploaded it. We do not publish, stream or distribute user uploads.

02Sending a takedown notice

Email edoublemusic@icloud.com with the subject DMCA Notice, including all of:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you say is infringed;
  3. identification of the material you say is infringing, with enough detail for us to locate it;
  4. your address, telephone number and email address;
  5. a statement that you believe in good faith the use is not authorised by the owner, its agent, or the law;
  6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.

Because uploads are never public, a notice here will in practice concern an account or a release we have been told about rather than a page you can browse to. Tell us what you know and we will investigate.

Incomplete notices may not be actionable. Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. §512(f).

03Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address including:

  1. your signature;
  2. identification of the removed material and where it appeared;
  3. a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
  4. your name, address and telephone number, and consent to the jurisdiction of the federal court for your district (or, if outside the US, any district in which we may be found), and that you will accept service from the person who sent the original notice.

We may restore the material in 10-14 business days unless the original complainant tells us they have filed a court action.

04Repeat infringers

We terminate the accounts of repeat infringers in appropriate circumstances.

Note on safe harbour

Full DMCA safe-harbour protection requires registering a designated agent with the US Copyright Office - a paid registration, renewable every three years, which also asks for a physical address. The Mix Medic has neither the registration nor a postal address, so we do not claim that safe harbour. This policy sets out the process we actually follow, and we follow it. Send notices to the email address above; they reach a person.
